Interesting discussion on trade and enployer unions. The abolishing of one but not the other, I think, happened during John Howard's time with Australian Workplace Agreements and WorkChoices. It allowed an opt-out from the award and union systems. This is all well and good, but the issue them becomes employers, and their associations, exploit that unbalanced labour market position, which they will inherently prefer to union bargaining, by offering 'take it or leave it deals' on terms beneficial to them.

However, I am still trying to think of a way where you can offer that freedom of contract in employment, yet quell an employer's superior bargaining position. I think that superior position arises due to more than just employer associations.
